1. ACCEPTANCE OF TERMS

By purchasing or using a membership at [Gym Name] (“the Gym,” “we,” “us,” or “our”), you (“Member,” “you,” or “your”) agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Gym facilities.

2. MEMBERSHIP TYPES AND FEES

2.2 Payment Terms
  • Membership fees are due in advance on the date specified in your membership agreement
  • Payments may be processed via automatic billing to your designated payment method
  • All fees are non-refundable unless otherwise specified
  • The Gym reserves the right to modify membership fees with 30 days’ written notice
2.3 Late Payments

Failure to pay membership fees when due may result in suspension or termination of membership privileges and may incur late fees.

3. MEMBERSHIP DURATION AND RENEWAL

3.1 Term

Your membership begins on the start date specified in your agreement and continues for the duration selected.

3.2 Automatic Renewal

Unless you provide written notice of cancellation, memberships may automatically renew for successive periods at the then-current rate.

3.3 Cancellation Policy
  • Members must provide [30] days’ written notice to cancel membership

  • Membership fees paid for the current billing period are non-refundable

4. FACILITY USE AND CONDUCT

Members may access the Gym during operating hours and use equipment and facilities in accordance with posted rules and staff instructions.

4.2 Age Restrictions

4.3 Guest Policy

  • Vandalize or steal Gym property
4.5 Dress Code

Members must wear appropriate athletic attire and closed-toe athletic shoes while using the Gym facilities.

5. HEALTH AND SAFETY

5.1 Medical Clearance

By using the Gym, you represent that you are in good physical condition and have no medical condition that would prevent safe participation in physical activity. You are encouraged to consult with a physician before beginning any exercise program.

5.2 Assumption of Risk

You acknowledge that physical exercise involves inherent risks of injury. You voluntarily assume all risks associated with your use of the Gym facilities and equipment.

5.3 Emergency Medical Treatment

In the event of a medical emergency, you authorize the Gym to secure emergency medical treatment on your behalf and agree to be financially responsible for any costs incurred.

5.4 Hygiene and Cleanliness
  • Members must wipe down equipment after use
  • Members must use towels when required
  • Members showing signs of contagious illness may be asked to leave the premises

6. WAIVER OF LIABILITY AND INDEMNIFICATION

6.1 Release of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE AND DISCHARGE THE GYM, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, RIGHTS OF ACTION, OR CAUSES OF ACTION, PRESENT OR FUTURE, ARISING FROM OR RELATED TO YOUR USE OF THE GYM FACILITIES, INCLUDING BUT NOT LIMITED TO CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.

6.2 Indemnification

You agree to indemnify and hold harmless the Gym from any claims, damages, losses, or expenses (including attorney fees) arising from your breach of these Terms of Use or your use of the Gym facilities.

7. PERSONAL PROPERTY

The Gym is not responsible for lost, stolen, or damaged personal property. Members use lockers and storage facilities at their own risk. The Gym reserves the right to remove abandoned property.

8. PRIVACY AND DATA PROTECTION

8.1 Personal Information

The Gym collects and maintains personal information as described in our Privacy Policy. By becoming a member, you consent to the collection and use of your information in accordance with our Privacy Policy.

8.2 Surveillance

The Gym premises may be monitored by video surveillance for security purposes.

9. SUSPENSION AND TERMINATION

9.1 Member-Initiated Termination

Members may terminate their membership in accordance with Section 3.3.

9.2 Gym-Initiated Termination

The Gym reserves the right to suspend or terminate any membership immediately and without refund for:

  • Violation of these Terms of Use
  • Abusive, threatening, or unsafe behavior
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Any reason deemed necessary for the safety and welfare of members and staff

10. MODIFICATIONS TO TERMS AND SERVICES

10.1 Changes to Terms

The Gym reserves the right to modify these Terms of Use at any time. Members will be notified of material changes via email or posted notice. Continued use of the Gym after changes constitutes acceptance of modified terms.

10.2 Changes to Facilities and Services

The Gym may modify, suspend, or discontinue any services, classes, or amenities at any time without notice.

10.3 Temporary Closures

The Gym may temporarily close for maintenance, repairs, emergencies, or other reasons. No refunds or credits will be provided for temporary closures of less than [insert number] consecutive days.
